Background

In the wake of Governor Maura Healey having signed legislation authorizing municipalities to opt-in to a temporary pilot allowing for the public consumption of alcohol in locally designated areas through July 31, the Downtown Boston Alliance (DBA) consulted with various neighborhood stakeholders–residents, bars and restaurants, public safety agencies, and more–to develop and implement a Downtown social district. The boundaries of the Temple Place social district encompass six establishments with liquor licenses–bars, gastropubs, lounges, restaurants, and more. The area includes with Temple Place’s famed “restaurant row,” which includes some of the best dining in the city.

Rules

1. Only on-premise licensees located within the designated social district may sell alcoholic beverages to be consumed within the district
2. Licensees must receive permission from the Licensing Board prior to selling alcoholic beverages for public consumption through submitting a one-day amendment application
3. Alcoholic beverages sold for public consumption must be the same size, proportion, and price as the same beverage sold for on-premise consumption
4. Beverages sold for public consumption must be sold in clear plastic containers with a sticker or other label or inscription noting the premise that sold the drink. Beverages normally sold in aluminum or glass containers must be poured into a clear plastic container in order to be sold for public consumption
5. Participating establishments may not sell more than one alcoholic beverage for public consumption per customer per transaction.
6. Bottles of wine may not be sold for public consumption
7. Patrons may not bring outside alcohol into a licensed premise. This includes alcohol that was purchased at another participating establishment.
8. Participating establishments are responsible for verifying the age and level of intoxication of all patrons
9. Participating establishments are responsible for educating patrons about the boundaries of the social district
10. The Licensing Board reserves the right to immediately modify or revoke a licensee’s ability to participate in the social district for excessive noise, overserving patrons, underage alcohol consumption, uncontrolled lines or loitering outside of the licensed premise, or any other violation of Mass. Gen. Laws Chapter 138 or 140 or any other law of the Commonwealth or Rules and Regulations of the Licensing Board or the Mayor’s Office of Consumer Affairs and Licensing.
